1. Scope

   These Terms of Service (“Terms”) govern the contractual relationship between you as a user (“User”) of the Radio Interactive App (“App”) or web-app and Radio Interactive GmbH, Hauptstr. 56, 91054 Erlangen, Germany (“Radio Interactive”, “we”, “us”). By registering, accessing, or using the App, you agree to these Terms. The legally binding version of these Terms is the German version (“Allgemeine Geschäftsbedingungen”). This English version is provided for convenience only. In case of discrepancies, the German version shall prevail.
   
   

2. Service Description

   The App provides an AI-powered tutoring, coaching, and mentoring platform for radiologists and medical students. It enables Users to enhance their medical knowledge by interacting with an AI Chatbot that presents educational cases and questions in the field of radiology. The App may include radiological images, simulated cases, and multimedia educational content. All content is for educational purposes only and does not constitute medical advice or clinical guidance.
   
   

3. Eligibility and Use Requirements

   Use of the App requires a verified user account. The App is intended for individuals aged 18 years or older with a medical background or medical students in training. A compatible device and active internet connection are required. Each account is for use by a single natural person. Account sharing or automated use is prohibited under our Fair-Use Policy. Fair-Use Policy: We reserve the right to monitor abnormal usage patterns to prevent account sharing or automated access. In cases of misuse, accounts may be warned, restricted, or terminated.
   
   

4. Data Protection and Privacy

   The processing of personal data complies with the EU General Data Protection Regulation (GDPR) and our Privacy Policy, which forms part of these Terms. 5. Intellectual Property and User Content

   Users retain copyright to their answers, but grant Radio Interactive a perpetual, royalty-free, worldwide, and transferable license to use, reproduce, and modify such content in anonymized form for educational and research purposes. All other intellectual property within the App, including the AI models, design, and content, remains the exclusive property of Radio Interactive GmbH.
   
   

6. Freemium Model and Subscriptions

   The App operates under a freemium model: Free version: access to basic functions with certain limitations, such as restricted question volume, limited topics, or difficulty levels. Premium subscription: full access for exam preparation, including unlimited questions (within Fair-Use Policy), topic selection, question skipping, and exam mode. Subscriptions are available monthly or annually and are billed exclusively via the respective App Store (Apple App Store / Google Play). Cancellation and refund policies are governed by the App Store terms. Users can cancel at any time through the store settings. After cancellation, premium access remains active until the end of the current billing period and automatically reverts to the free version thereafter.
   
   

7. Disclaimers and Limitation of Liability

   Educational Purpose Only: The App, its content, newsletters, and associated materials are provided for informational and educational purposes only. They do not constitute medical advice, diagnosis, or treatment recommendations. Users must always rely on their own clinical judgment and consultation with qualified colleagues when making medical decisions.

   No Warranties: The App and its content are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied, including but not limited to warranties of accuracy, reliability, or fitness for a particular purpose.

   Limitation of Liability: To the maximum extent permitted by law, Radio Interactive GmbH shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use the App. This does not affect liability for damages resulting from intentional misconduct or gross negligence, or for injury to life, body, or health. Users access and use the App at their own risk.
   
   

8. Changes to the Terms

   We may amend these Terms with a 30-day notice period before they take effect. Users will be notified through the App or via email. Continued use after the effective date constitutes acceptance of the updated Terms. If you do not agree, you may terminate your subscription without penalty before the new Terms take effect.
   
   

9. Governing Law and Jurisdiction

   These Terms are governed by the laws of Germany, without regard to conflict-of-laws principles. The exclusive place of jurisdiction shall be Erlangen, Germany, provided that the user is not a consumer or does not reside within the European Union. For consumers residing outside Germany, mandatory consumer protection laws of their country of residence remain unaffected.
   
   

10. Severability

    If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
